Terms of service

These Terms of Service govern your use of meaira.com and every order you place through it. Meaira is a trading name of POLARYS SIMO LLC, and in these terms "we", "us" and "Meaira" refer to that company. By placing an order you accept these terms.

Meaira is an online clothing shop operated by POLARYS SIMO LLC, 8206 Louisiana Blvd NE, Ste A #8387, Albuquerque, NM 87113, United States. You can reach us by email at info@meaira.com. Our support hours are Monday to Friday, 9:00 AM to 5:00 PM EST/EDT (Eastern Time).

Using this website

You may browse and buy from meaira.com for your own personal use. You may not copy, republish or resell our product photography, product descriptions or page content, and you may not use automated tools to scrape the site or to place orders. You also agree not to use the site in a way that damages it, interferes with anyone else's use of it or attempts to gain access to parts of it that are not public.

We may change the content of the site, the products we offer and these terms at any time. The version of these terms that applies to your order is the version published when you place it.

Products and product information

We describe our products as accurately as we can and photograph them as they are. Screens render colour differently, so the shade you see on your device can differ slightly from the item in daylight. Product availability changes as stock moves, and an item shown as available at the moment you add it to your cart may sell out before you complete the order.

Sizes follow the labelling of the item as supplied to us. If you would like help choosing between two sizes, write to us before ordering and we will answer during our support hours.

Prices and currency

All prices are shown in US dollars (USD). Shipping is free on every order. Duties and import fees are included in the price, so nothing further is collected from you on delivery. Any sales tax that applies to your delivery address is calculated at checkout.

We take care with pricing, but if an obvious error appears on the site, for example a price that is clearly wrong by an order of magnitude, we reserve the right to cancel the affected order and refund you in full rather than fulfil it at that price. We will always contact you first.

How a contract is formed

Adding items to your cart places no obligation on either side. When you complete checkout, you make an offer to buy. You then receive an order confirmation email that acknowledges we have received it. The contract between us comes into effect when we dispatch your order and send you the shipping confirmation.

We may decline an order where the item is no longer available, where we identify a pricing error, where the delivery address is outside the United States, or where we have reason to believe the order is fraudulent. If we decline an order that has already been paid, you are refunded in full.

Payment

Payment is taken when you place your order. Accepted methods are listed on our Payment Policy page and shown again at checkout. Payments are processed by Shopify's checkout, and card details are handled by the payment processor, not by us.

Delivery

We ship within the United States only. Orders are prepared within 1 to 2 business days and transit takes 3 to 5 business days, giving a total of 4 to 7 business days from order to delivery. The daily cut-off is 5:00 PM EST/EDT (Eastern Time). Full details, including what happens if a parcel is delayed, lost or damaged, are in our Shipping Policy, which forms part of these terms.

Risk in the goods passes to you on delivery. Where a change of mind return is sent back to us, the parcel travels at your risk until it reaches us.

Returns, exchanges and refunds

You have 30 days from delivery to register a return. Exchanges for a different size or colour are free of charge and the replacement is dispatched as soon as the exchange is registered. On a change of mind return you pay the return shipping; where an item is faulty, damaged or not what you ordered, we pay it. We inspect returned items and issue refunds to the original payment method within 5 days of receiving the return. Refunds for orders cancelled before dispatch are issued within 5 days of cancellation being confirmed. The complete rules are in our Returns and Refunds policy, which forms part of these terms.

Faulty items and your legal rights

Items sold by Meaira are expected to be free from material defects and to match their description. If something arrives faulty or does not match what was described, contact us with photographs and your order number and we will put it right by replacement or refund, and we pay the return shipping.

Nothing in these terms limits the rights you have under the consumer protection law that applies where you live. In particular, the limitation of liability below does not exclude our obligations for faulty goods, for goods that do not match their description, or for the returns and refunds set out in our policies.

Limitation of liability

Subject to the paragraph above, our liability in connection with an order is limited to the amount you paid for that order. We are not liable for indirect or consequential loss, for loss of profit, or for delays caused by events outside our reasonable control, including severe weather, carrier disruption, industrial action and public emergencies.

The website is provided as it is. We work to keep it available and accurate, but we do not promise uninterrupted access, and we are not liable for losses caused by the site being temporarily unavailable.

Intellectual property

The Meaira name, our logo, the text on this site and the photography we produce belong to POLARYS SIMO LLC or are used with permission. You may not reproduce them commercially without our written consent.

Your account and your data

Where you provide personal information to place an order or to contact us, we handle it as described in our Privacy Policy. You are responsible for keeping the details you give us accurate, in particular your delivery address and your email address, since both are needed to complete your order.

Communication

We communicate with you by email: order confirmations, shipping confirmations, return and refund confirmations and answers to your questions. Please add our address to your contacts so these messages are not filtered into a spam folder.

Governing law

These terms are governed by the laws of the State of New Mexico and of the United States. Any dispute arising from them is subject to the jurisdiction of the courts of New Mexico, without affecting any right you have to bring a claim in the courts of the state where you live.

Severability

If any part of these terms is found to be unenforceable, the rest continues to apply. Failure by us to enforce a term on one occasion does not mean we give up the right to enforce it later.
